DOL Releases final FLSA Salary Threshold - New Rules go into effect 1/1/2020

As expected, the Department of Labor (DOL) has released final FLSA salary thresholds that will go into effect January 1, 2020. Under the new rules, employees that earn less than $35,568 (annual) or $684 (weekly) will become overtime-eligible. The new rule also raises the highly compensated threshold slightly to $107,432, of which at least $684 must be paid weekly.


As a reminder, meeting the salary threshold is only one test for determining exemption from overtime. In addition to exceeding the salary threshold, the employee/job must also satisfy one of the additional duties tests.


Given the short timeframe for compliance, it is critical to review the current impact on your organization to ensure you are compliant for 1/1/2020.
